Right To Representation

Veterans should have a clear understanding of their right to representation should they ever need it.  If you are wondering if you have the right to have someone legally represent you with your VA appeal the answer is ‘YES’!  However, you are not required to have someone represent you.  Thus it is totally your choice.

You can have a Veterans Service Organization representative, an attorney-at-law, or an agent help you with your appeal.  Because representatives who work for accredited Veterans Service Organizations know how to prepare and present claims this is ideal.  Also, they are readily available to help you.  Additionally, you can find a listing of these organization at http://www.va.gov/vso/. However, it is important to note, as stated on the VA website:

 

Inclusion of an organization in the directory does not constitute approval or endorsement by VA or the United States Government of the organization or its activities. Some VSOs are “chartered”, which means they are federally chartered and/or recognized or approved by the VA Secretary for purposes of preparation, presentation, and prosecution of claims under laws administered by the Department of Veterans Affairs. Inclusion of non-chartered organizations does not constitute or reflect VA recognition of said organization and its representatives for purposes of representation of VA claimants. http://www.va.gov/vso/
