The Appeals Modernization Act (AMA) is a significant reform implemented by the Department of Veterans Affairs (VA) to streamline and improve the appeals process for veterans seeking benefits. Understanding the Appeals Modernization Act (AMA)

The Appeals Modernization Act signed into law in August 2017, aimed to provide veterans with more options and control over their VA appeals. The primary objective was to reduce the appeals backlog and create a more efficient, transparent, and veteran-centric system.

Before the implementation of the AMA, veterans had limited options when it came to challenging decisions made by the VA. The appeals process was often lengthy and complex, leading to frustrating delays for veterans seeking their entitled benefits. 

The previous appeals process consisted of two main paths: the Legacy Appeals System and the Decision Review Officer (DRO) Process.

  • Legacy Appeals System: Under the Legacy Appeals System, veterans could choose to file a Notice of Disagreement (NOD) to initiate the appeal. This would start the multi-stage process that included a review by a VA Regional Office, issuing a Statement of the Case (SOC), and an opportunity to submit a Substantive Appeal. The case would eventually reach the Board of Veterans’ Appeals (BVA) for a decision.
  • Decision Review Officer (DRO) Process: Veterans could request a DRO review as an alternative to the Legacy Appeals System. This involved having a VA employee, a Decision Review Officer, conduct a new review of the case and reconsider the previous decision—the DRO review aimed to provide a faster resolution than the traditional appeals process.

However, both options were often characterized by lengthy processing times and a lack of transparency, leading to frustration and delays for veterans seeking benefits. The introduction of the Appeals Modernization Act sought to address these challenges and provide veterans with a more efficient and veteran-centric appeals process.

Key Features of the Appeals Modernization Act

Under AMA, veterans can choose from three review options for their appeals. These options include the Supplemental Claim Lane, the Higher-Level Review Lane, and the Board of Veterans’ Appeals (BVA) Lane. This flexibility empowers veterans to select the review option that best suits their circumstances.

  1. Supplemental Claim: In this lane, veterans can submit new and relevant evidence to support their claims. This option allows them to provide additional information not previously available during the initial claim review.
  2. Higher-Level Review: Veterans can have their appeals reviewed by a more senior VA official. This official reevaluate the case based on the evidence already provided without considering any new evidence. This review option is ideal for cases where the evidence is already strong and the focus is on potential errors in the initial decision.
  3. Appeal: This lane is for veterans who have their claims reviewed by a Veterans Law Judge. This review option provides an opportunity for a formal hearing, during which the veteran can present oral arguments and evidence. The Appeal, or BVA, Lane is suitable for complex cases or situations where the veteran prefers a traditional appeal process.
