VA Claim Step 8: How Long Does the ‘Claim Decided’ Stage Take

Step 8 is the final stage of the VA disability claim process. At this point, the VA has completed its review, made a decision on your claim, and is sending you the official notification.

What happens in Step 8?

In this phase, the VA has already finalized your disability rating and eligibility. The primary action here is the communication of that decision to you.

  • Packet mailed: The VA sends a complete decision packet to your address on file via U.S. mail.
  • Online availability: While the physical packet is being mailed, you can often view the decision letter digitally on VA.gov before the mail arrives.

Timeline

  • Mailing time: You should typically receive the physical decision packet within 7 to 10 business days after the status moves to Step 8.
  • Online access: The digital version is often available immediately or within 24 hours of the status update.

What is in the decision packet?

The decision packet is the most critical document in your claim. It contains:

  1. Decision on service connection: Whether your claimed disabilities were found to be service-connected (granted) or not (denied).
  2. Disability rating: The percentage rating assigned to each service-connected disability (e.g., 10%, 30%, 50%).
  3. Combined rating: Your total combined disability rating, which determines your monthly compensation amount.
  4. Effective date: The date from which you are eligible to receive payment (often the date you filed the claim or the intent to file date).
  • Updated monthly payment amounts: The Notification Letter will include a monthly breakdown of the updated monthly payment amounts, beginning with the effective date and ending as of the present.

How to Check Your Decision Online

You do not have to wait for the mail. To view your letter online:

  1. Log in to VA.gov.
  2. Go to the “Check your claim and appeal status” tool.
  3. Navigate to the “Letters” or “Documents” section of your claim.
  4. Look for a link that says “Get your claim decision letter.”

Next Steps

If Your Claim Was Approved

  • Check for payment: Retroactive payments usually deposit within 15 days of the decision. Recurring monthly payments generally begin on the first of the following month.
  • Review benefits: Check if your rating qualifies you for additional state or federal benefits (e.g., property tax exemptions, healthcare priority).

If You Disagree (Appeals)

If your claim was denied, or if you believe the rating is too low, you have the right to appeal. The decision packet will include a form (typically VA Form 20-0998) outlining your appeal options:

  • Higher-level review: Requesting a senior reviewer to look at the same evidence again.
  • Supplemental claim: Submitting new and relevant evidence that was not previously considered.
  • Board appeal: Appealing directly to the Board of Veterans’ Appeals (BVA) for a judge to review the case.

Note: You generally have one year from the date on the decision letter to file an appeal to preserve your effective date.
